General Terms and Conditions

1. Purchase on a Trial Basis

At Seibersdorfer Bettfedern- und Daunen GmbH, you purchase on a trial basis. This means that you can return delivered goods, without specifying the reasons for doing so, within 14 days of receiving them. The purchase agreement becomes binding following receipt of the goods upon your acceptance. The goods are deemed to have been accepted if you do not notify us otherwise or return the delivered goods to us within the 14-day acceptance period. Following acceptance, you also have the right to cancel, as described below.

2. Cancellation Policy

2.1. 2.1. Cancellation Right

You have the right to cancel this contract within 14 days without specifying the reasons for doing so. The cancellation period is 14 days from the date that you or a third party specified by you, who is not the carrier, received the last item(s). However, the period does not commence before the purchase agreement has become binding through your acceptance of the purchased item(s). To exercise your cancellation right, please inform us (Seibersdorfer GmbH, Johann Strauß Straße 1, 2485 Wampersdorf, Austria, tel.: +43 (0)2623/72558 , fax: +43 (0)2623/72558-24, email: kundenservice@seibersdorfer.at) of your decision to cancel this contract by sending a clear notification (e.g., by post, fax, or email). You can use the provided cancellation form template to do so, though this is not mandatory. In order to comply with the cancellation period, it is sufficient to notify us of your decision to exercise your cancellation right before the cancellation period ends.

2.2 Consequences of Cancellation

If you cancel this contract, we will refund to you all payments that we have received from you, including delivery costs (excluding any additional costs incurred as a result of you choosing a different type of delivery to the cheapest standard delivery option that we offer), without delay and within 14 days at the latest from the date on which we receive notification of your cancellation of this contract. We will make the refund via the same payment method that you used in the original transaction unless expressly agreed otherwise with you; you will not be charged any fees in connection with this refund. We may refuse to issue the refund until we have received the goods back or until you have provided proof that you have sent the goods back, depending on which occurs first. You must return the goods to us without delay and in any case within 14 days at the latest from the date on which you notify us of the cancellation of this contract. In the case of goods that can be sent by parcel post, this period is considered to have been complied with if you send the goods before the 14-day period expires. We shall bear the costs of returning the goods; this does not apply to customers outside of Austria. You must only pay compensation for any loss of value of the goods if this loss of value is caused by handling of the goods that was not required in order to check the condition, properties, and function of the goods.

2.3. 2.3. Exclusion/Expiry of the Cancellation Right

There is no right to cancel in the case of contracts for the delivery of goods that are not ready-made and where the consumer’s personal choice or instruction is decisive with regard to the manufacture of these goods (e.g., individual filling quantity), or goods that are uniquely tailored to the personal requirements of the consumer (e.g., special sizes), and the right to cancel expires prematurely in the case of contracts for the delivery of sealed goods that, for health protection or hygiene reasons, are not suitable for return if their packaging has been removed after delivery. Used pillows, comforters, mattresses, mattress toppers, bed linen and similar are explicitly excluded from the cancellation right.

3. Voluntary Money Back Guarantee

In addition to the statutory cancellation right, we also offer a voluntary money back guarantee for 30 days following receipt of the goods for all purchases from the Seibersdorfer range. Following acceptance of the purchase agreement and expiry of the 14-day cancellation period, you may withdraw from the contract by returning the goods to us within 30 days following receipt of the goods (period begins on day after receipt of goods), provided that the goods are complete and in their original packaging, and that they are in an unused and undamaged condition. The period is considered to have been complied with if the goods are sent on time. The goods are to be returned to: Seibersdorfer GmbH, Johann Strauß Straße 1, 2485 Wampersdorf, Austria.
Your statutory rights and entitlements are not affected by the contractual voluntary money back guarantee. In particular, your statutory cancellation right and your warranty rights remain unrestricted.

4. Contract Language

The contract, order, and business language is German.

5. Orders

As a general rule, orders and deliveries can only be made within Austria, the EU, and Switzerland. Should you require delivery to another country, we will do our best to assist you. Goods will be sold in household quantities only.

6. Validity of Prices

The prices specified on www.seibersdorfer.at are online prices in Euros (including statutory sales tax).

7. Shipping Costs

Shipping costs per order and delivery address are dependent on the order value and the place of delivery: Parcel deliveries with a goods value of over €200 are delivered free of charge within Austria. For specially labeled items that must be sent by shipping company on account of their bulkiness or weight, we calculate the delivery costs on an individual basis according to the delivery address.

8. Payment

Which payment options are available to you when placing an order?

8.1. 8.1. Cash on Delivery

If paying cash on delivery, a fee of EUR 5 will be charged in addition to the shipping costs.

8.2. 8.2. PayPal

You also have the option of paying via PayPal. If you choose this option, please observe the PayPal general terms and conditions and any associated costs, particularly in the case of refunds if returning items. Seibersdorfer assumes no liability and provides no reimbursement for any fees incurred in this case. If you do not have a PayPal account, it is possible to pay by credit card via PayPal.

8.3. 8.3. Prepayment

Transfer the payment directly to our bank account. Please use the order number as the payment reference. Your order will be sent once we have received the money in our account.

8.4 Credit card

By submitting the order, you provide your credit card information and the credit card company performs an authorization check. After your legitimation as a legitimate cardholder, the payment transaction will be carried out automatically and your card will be charged.

8.5 Sofort by klarna

After placing the order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have an online banking account with PIN/TAN procedure activated for participation in Sofort, identify yourself accordingly and confirm the payment instruction to us. You will receive further instructions during the ordering process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.

8.6 Amazon Pay

In the ordering process, you will be redirected to the website of the online provider Amazon even before completing the ordering process in our online store. In order to complete the order process and pay the invoice amount via Amazon, you must be registered there or register first and legitimize yourself with your access data. There you can choose the delivery address and payment method stored at Amazon, confirm the use of your data by Amazon and the payment instruction to us. You will then be redirected back to our online store where you can complete the ordering process. Immediately after placing the order, we request Amazon to initiate the payment transaction. The payment transaction is carried out automatically by Amazon. You will receive further instructions during the ordering process.



9. Retention of Title

We retain ownership of all goods that we deliver until such time that the purchase price has been paid in full.

10. Electronic Communication

You agree that contract-related communication may take place in electronic form.

11. Data Protection

Data protection is important to us. How do we process your data?

11.1. 11.1. General

When using and processing your data, we adhere strictly to data protection regulations. Your data that is required for business purposes is stored and, where necessary for order processing and the promotion of our own products and services, sent to Seibersdorfer GmbH, Johann Strauß Straße 1, 2485 Wampersdorf with its registered office in Austria and our partner companies with registered offices in the EU for the purposes of customer support, delivery, and contract execution, as well as for the creation and distribution of advertising material. We have selected our partners with care. They have an obligation toward us, in accordance with statutory regulations, to handle your data in confidence, as well as to observe our own data protection standards. In particular, our partners are not permitted to pass on our customers’ data to third parties for their own purposes or for advertising purposes.
You can view your contract data in the ‘Mein Konto’ (My Account) section of seibersdorfer.at by logging in using your personal details.

11.2. 11.2. Anonymous Storage of Movement Data

You are shown personal recommendations on seibersdorfer.at. These are based on items that you have previously viewed, searched for, or purchased on www.seibersdorfer.at. This information is stored in a cookie in anonymized form. Your personal data, such as your name, date of birth, and address, is not stored and it is not possible to identify you based on the information stored.

You expressly give your consent to your name, date of birth, address and, if subscribed to the newsletter, your email address and telephone number being used and forwarded to the following cooperation partners, and agree to receive information material for advertising purposes (e.g. newsletter, product or service information) by mail, SMS, telephone, or email, both from us and from the cooperation partners listed below.

This website uses Google Analytics, a web analytics service provided by Google Inc. („Google“). Google Analytics uses cookies. 11.5 Youtube-Videos

We have integrated YouTube videos on some sections of our website. These videos are stored on the servers of the provider, YouTube, and can be played back from our website by means of embedding. The videos are embedded with the option to enable advanced privacy settings. When you play these videos, YouTube cookies and DoubleClick cookies are stored on your computer and data may be sent to Google Inc., Amphitheater Parkway, Mountain View, CA 94043, USA, as the YouTube operator.

When you play videos stored on YouTube, at least the following data is currently sent to Google Inc. as the YouTube operator and as the operator of the DoubleClick network: IP address and cookie ID, the specific address of our page that is accessed, system date and time of access as well as your browser ID.

The transfer of this data takes place irrespective of whether you have a Google user account that you are logged into or whether you do not have a user account. If you are logged into your Google user account, Google may link this data directly to your account. If you do not want the data to be linked to your profile, you will need to log out of your account before pressing the play button for the video.

YouTube and Google Inc. store this data as usage profiles and may use these for the purposes of advertising, market research, and/or ensuring that their websites are designed appropriately. Such analysis is carried out in particular (including for users who are not logged in) in order to deliver appropriate advertising and to inform other users about your activities on our website. 11.6 Contact Form

When you send us an inquiry via the contact form, we will store your information from the inquiry form, including the contact details that you have provided therein, for the purposes of processing the inquiry and in case there are any follow-up questions. 11.7 Changes to Our Data Protection Regulations

We reserve the right to adapt this privacy policy occasionally so that it always meets the current legal requirements or to incorporate changes to our services into the privacy policy, e.g., if new services are introduced. When you next visit, the new privacy policy will then apply.

12. Right of Access and to Rectification, Blocking, and Erasure of Stored Data

You have a right of access and a right to the rectification, blocking, or erasure of your stored data free of charge at any time. This right is limited only to the extent that we may suspend erasure in order to safeguard our claims.

13. Exclusion of Liability for External Links

On our website, we make references to other sites online via links. For all these links, the following applies: We explicitly state that we have no influence whatsoever over the design or content of the linked sites. We therefore hereby expressly disassociate ourselves from all content on all linked third-party websites on www.seibersdorfer.at and do not endorse this content. 14. Image Rights

All image rights belong to us or our partners. Any use of images, even only parts thereof, is not permitted without our express consent.

15. Warranty

Your warranty claims exist in accordance with the statutory provisions. The statutory warranty period is 24 months. We recognize the extrajudicial arbitration body of the quality mark and the Internet Ombudsman.

Downproofness

Down comforters and pillows are high-quality natural products and are tested accordingly. With natural materials, it is normal for down to occasionally escape. Downproof pursuant to the IDFL 20-1 Rotating Box test method (version: April 2014)

16. Applicable Law

Austrian law applies to all legal transactions, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.

17. Place of Jurisdiction

Where the customer is a consumer within the meaning of the Austrian Consumer Protection Act (Konsumentenschutzgesetz), the court for the judicial district where the customer’s domicile, habitual residence, or place of employment is located is responsible for any legal disputes. In all other cases, the competent court at the company’s location is agreed as the place of jurisdiction.

18. Traumpass Products

For our products featuring the Traumpass:

  • We shall not use down or feathers that are obtained using inhumane methods.
  • We shall use feathers and down that are obtained from dead animals for bedding featuring the ‘Traumpass’ feather seal.
  • We shall only use eiderdown that has been obtained in compliance with statutory requirements.
  • We shall document the traceability of the down and feathers used in bedding featuring the ‘Traumpass’ feather seal in accordance with the documentation requirements.
  • We shall adhere to the EDFA Traceability Standard for the purposes of traceability.
